Terms of Service

These Terms of Service (“Terms”) govern your use of the Sober Living Companion mobile application, website, and related services (the “Services”), operated by Empower Next Project, a non-profit organization (EIN 39-3580172) (“we,” “us,” or “our”). By creating an account or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Who may use the Services

You must be at least 18 years old to use the Services. By using them, you represent that you meet this requirement and that the information you provide is accurate and current.

2. Accounts & roles

The Services include facilitator accounts (for sober living operators and house managers) and resident accounts. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Facilitators are responsible for the residents and data they manage within their home.

3. Membership & contributions

Sober Living Companion offers a monthly membership for sober living homes (currently $60/month). Because we are a tax-exempt non-profit, your membership is tax-deductible to the extent allowed by law, and we provide a receipt for your records. Memberships renew monthly until cancelled and can be cancelled at any time. The App is free for residents.

4. Payments between users

Rent and other payments are made through third-party payment services such as CashApp and Zelle. We are not a party to those transactions, are not a bank or money transmitter, and are not responsible for amounts owed, paid, or disputed between residents and homes. The Services simply help record and display payment status.

5. Acceptable use

You agree not to misuse the Services, including by: violating any law; uploading harmful or unlawful content; attempting to access accounts or data that are not yours; interfering with the security or operation of the Services; or using the Services to harass or harm others.

6. Not medical or emergency services

Important: Sober Living Companion is a support and management tool. It is not a medical, clinical, or emergency service and does not provide medical advice or treatment. The SOS feature notifies your facilitator but is not a substitute for 911 or professional emergency help. If you or someone else is in danger or experiencing a medical or mental-health emergency, call 911 (or your local emergency number) immediately. For substance-use support in the U.S., you can call or text the SAMHSA National Helpline at 1-800-662-4357 or the 988 Suicide & Crisis Lifeline.

7. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

8. Intellectual property

The Services, including their content, design, and software, are owned by Empower Next Project and its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Services for their intended purpose. You retain ownership of the content you submit, and you grant us the limited rights needed to operate the Services.

9. Third-party platforms

If you download the App from the Apple App Store or Google Play, your use is also subject to those platforms' terms. Those platforms are not responsible for the Services and are not parties to these Terms.

10. Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the Services will be uninterrupted, error-free, or secure.

11. Limitation of liability

To the fullest extent permitted by law, Empower Next Project and its officers, volunteers, and partners will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of the Services.

12. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Services or other users.

13. Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date and, where appropriate, notify you. Continued use after changes means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
